Important Points

  • Bookanywhere is an online marketplace. It does not operate vehicle rental services of its own. In order to provide a wide-ranging choice of vehicle, prices of vehicle and availability of vehicle in particular area to the customers, it has created a platform (the website) where customer can find many vehicle rental agents. Bookanywhere doesn’t have any personal contact with any agent or any customer and therefore is not responsible for any unfavorable experience.

  • The customer must be at least 18 years old to be able to book a vehicle as he/she must have a valid driving license.

  • In any circumstance if the customer who booked a vehicle is a minor than proving him with vehicle and the outcome of the same will be responsibility of the agent only and Bookanywhere is not liable in any way.

  • If the customer books a vehicle for a particular day and doesn’t show up on that day he/she will be charged i.e. no refund will be provided.

  • Bookanywhere advice to customers is to give preference to vehicle agents they are aware of and whose service they are comfortable with.

  • The agent should provide correct information and legal documents of the vehicle on the website. Under any circumstances Bookanywhere is not accountable for any inconvenience to the customer due to the inaccuracy relating to the information made available on our website.

  • The website provides a facility of ratting and commenting on the service provided by the agent. However the certainty behind these ratings and the matters of the comments depend on the customer and Bookanywhere as no control over this and is not accountable for any unpleasant experiences.

  • For any unfortunate events occurring during the intake of the service (like vehicle breakdown) the customer should contact the agent and not Bookanywhere

  • Any kind of damages, loss of profit, loss of revenue, loss of contract, loss of or damage to goodwill or reputation, loss of claim to either parties i.e. customer and agent is not responsibility of Bookanywhere

Bookanywhere will not be liable to you or to any other person for any direct, indirect, incidental, punitive or consequential loss, damage, cost or expense of any kind whatsoever and howsoever caused from out of the information derived by you through your usage of this Site. In no event shall Bookanywhere be liable for any direct, indirect, punitive, incidental, special, or consequential damages arising out of information provided on the website in so far as such information is derived from other service providers.

Bookanywhere responsibilities includes

  • Providing customer and agents support and information regarding booking process.

  • Providing customers feedbacks to the agents for improving their service.

Bookanywhere responsibilities DO NOT includes

Regarding Customer
  • Any inaccuracy relating to the (descriptive) information (including rates, availability and ratings) of the service as made available on our website.

  • Providing and not proving refund or providing partial refund totally depends on agent.

  • The agent or agents employees being rude.

  • The vehicle provided by agent not being up to the customer’s expectation.

  • The agent delaying to provide the vehicle to the customer.

  • The agent not providing vehicle original documents.

  • The agent not providing any type of vehicle accessories like helmet, carriers etc.

  • The agent not providing any particular services that he claimed on the website to provide.

  • The agent not providing vehicle due to unavoidable reason.

  • The vehicle breaking-down.

  • Grievances and claims related to the provision.

Regarding Agent
  • The customers identity.

  • The customer being rude.

  • The customer misplacing vehicle documents or any vehicle accessories.

  • The customer meeting with a calamity, accident.

  • The customer do not returning the vehicle on time.

  • The customer not returning vehicle.

  • The vehicle breaking-down.

  • Damage to vehicle.

Communication Policy

  • By accepting the terms and conditions the customer accepts that Bookanywhere may send the alerts to the mobile phone number provided by the customer while registering for the service or to any such number replaced and informed by the customer. The customer acknowledges that the alerts will be received only if the mobile phone is in ‘On’ mode to receive the SMS. If the mobile phone is in ‘off’’ mode then the customer may not get / get after delay any alerts sent during such period.

  • Bookanywhere will make best efforts to provide the service and it shall be deemed that the customer shall have received the information sent from Bookanywhere as an alert on the mobile phone number provided during the course of booking and Bookanywhere shall not be under any obligation to confirm the authenticity of the person(s) receiving the alert. The customer cannot hold Bookanywhere liable for non-availability of the service in any manner whatsoever.

  • The customer acknowledges that the SMS service provided by Bookanywhere is an additional facility provided for the customer’s convenience and that it may be susceptible to error, omission and/ or inaccuracy. In the event the customer observes any error in the information provided in the alert, Bookanywhere shall be immediately informed about the same by the customer and Bookanywhere will make best possible efforts to rectify the error as early as possible. The customer shall not hold Bookanywhere liable for any loss, damages, claim, expense including legal cost that may be incurred/ suffered by the customer on account of the SMS facility.

  • The customer acknowledges that the clarity, readability, accuracy, and promptness of providing the service depend on many factors including the infrastructure, connectivity of the service provider. Bookanywhere shall not be responsible for any non-delivery, delayed delivery or distortion of the alert in any way whatsoever.

  • The customer agrees to indemnify and hold harmless Bookanywhere and the SMS service provider including its officials from any damages, claims, demands, proceedings, loss, cost, charges and expenses whatsoever including legal charges and attorney fees which Bookanywhere and the SMS service provider may at any time incur, sustain, suffer or be put to as a consequence of or arising out of (i) misuse, improper or fraudulent information provided by the customer, (ii) the customer providing incorrect number or providing a number that belongs to that of an unrelated third party, and/or (iii) the customer receiving any message relating to booking confirmation, cancellation of booking from Bookanywhere and/or the SMS service provider.

  • By accepting the terms and conditions the customer acknowledges and agrees that Bookanywhere may call the mobile phone number provided by the customer while registering for the service or to any such number replaced and informed by the customer, for the purpose of collecting feedback from the customer regarding their experience, the facilities and/or services of the vehicle agent.

Disclaimer

Subject to the limitations set out in these terms and conditions and to the extent permitted by law, we shall only be liable for direct damages actually suffered, paid or incurred by you due to an attributable shortcoming of our obligations in respect to our services, up to an aggregate amount of the aggregate cost of your reservation as set out in the confirmation email (whether for one event or series of connected events).

However and to the extent permitted by law, neither we nor any of our officers, directors, employees, representatives, subsidiaries or others involved in creating, sponsoring, promoting, or otherwise making available the site and its contents shall be liable for

  1. any punitive, special, indirect or consequential loss or damages, loss of profit, loss of revenue, loss of or damage to goodwill or reputation, loss of claim.

  2. Any inaccuracy relating to the (descriptive) information (including rates, availability and ratings) of the service as made available on our website.

  3. The services offered by the agent.

  4. Any (direct, indirect, consequential or punitive) damages, losses or costs suffered, incurred or paid by you, pursuant to, arising out of or in connection with the use, inability to use our website.

  5. (for any (personal) injury, death, property damage, or other (direct, indirect, special, consequential or punitive) damages, losses or costs suffered, incurred or paid by you,whether due to (legal) acts, errors, breaches and unsatisfactory service from the agent, including any (partial) cancellation, overbooking, strike or any other event beyond our control.

Cancellation Policy

Bookanywhere cancellation of the booking totally depends on the agent.

Some agent may not be providing facility of cancellation/refund.

Agents who provide the facility of cancellation/refund however may have their own cancellation policy and may charge user accordingly.

Cancellations can be done online (only if conventional by the particular agent).

Cancellations are only through our website (online cancellation). However we would introduce call center cancellation in the near future.

Modifications & Refunds

Bookanywhere doesn't support changes and modifications to online bookings once they're made.

Don't call the agents for changes or cancellations. The vehicle agents do not make changes to or process refunds directly.

Website might take up to 10 working days to process refunds for bookings cancelled online.

Your bank may debit its own separate charges from refunds made to your credit card or bank account.
